Gratuity, also known as End-of-Service Benefits (EOSB), is a statutory financial payment provided to eligible expatriate workers in the UAE when their employment contract is terminated or concluded. It serves as a reward for loyalty and continuous service.

For employees with at least one year of continuous service, gratuity is calculated as follows:

  • First 5 years of service: 21 days’ basic salary for each year worked.

All calculations are pro-rated for partial years, provided the initial 1-year threshold has been met.

Under the current unified UAE Labour Law (Decree-Law No. 33 of 2021), the calculation rates are identical regardless of whether you resign or are terminated. The old reduction rules for resignation under unlimited contracts (1/3 or 2/3 reductions) no longer apply to modern contracts.

Under the latest rules, all private-sector employees in the UAE must be transitioned to fixed-term (limited) contracts. Distinctions in gratuity calculations between limited and unlimited formats have been abolished for new periods of service. However, calculations for older legacy contracts prior to February 2022 still require these parameters.

Yes. If you fail to serve your required legal notice period upon resignation, your employer is entitled to deduct compensation in lieu of notice (equivalent to your basic salary for the notice days not served) from your final settlement balance.
