Contract Renewal Gratuity UAE: Does Your Service Reset?

No. It doesn’t.

Contract renewal gratuity UAE rules are simpler than most people assume. Your service runs continuously from the day you first joined, no matter how many times your contract has been signed, renewed or reissued since. If you started in 2019 and you’re now on your third two-year contract, you have seven years of service — not two.

This matters because contract renewal gratuity in UAE is one of the most common places employees lose money, and most of the time nobody is being deliberately dishonest. HR pulls the start date from the current contract, the number comes out low, and the employee has no idea it should have been higher.

Here’s what the law actually says, what it costs you if the wrong date is used, and how to prove your real start date.

How Contract Renewal Gratuity UAE Rules Actually Work

Federal Decree-Law No. 33 of 2021 bases gratuity on your continuous period of service with the same employer — not on the term of whichever contract happens to be current.

A renewal is a continuation of the same employment relationship. It isn’t a new job. Your employer hasn’t rehired you, your visa hasn’t been reissued from scratch, and your entitlements haven’t been reset.

Practically, that means:

  • Your service starts on your original first working day
  • Every renewal since then adds to that period
  • Your accrual bands are counted from that original date, not from the latest signature

That last point is where the real money sits.

What the Wrong Date Actually Costs

Take someone on AED 8,000 basic who joined in 2019 and is now finishing their third two-year contract. Seven years of service.

The Part Most People Miss

Gratuity accrues at 21 days of basic wage per year for your first five years, then 30 days per year after that.

If your service is reset at every renewal, you never reach year six. You stay permanently stuck in the 21-day band, no matter how long you actually work there.

Someone with twelve years of genuine service on AED 8,000 basic should receive AED 84,000. Reset at every two-year renewal, they’d receive AED 11,200 each time — around AED 67,200 across six settlements, and only if every single one was actually paid out.

The reset doesn’t just shift the date. It removes the entire benefit of long service.

What Happens at a Genuine Break in Service

Renewals aren’t the only thing people get confused about. A few real situations:

Your contract expired and was re-signed weeks later

If you continued working, or the gap was administrative, your service is generally still continuous. What matters is whether the employment relationship actually ended.

You resigned, were paid your gratuity, then re joined

This is a genuine break. Your service restarts from the rejoining date, because the previous period was already settled.

You moved to a different company under the same group

This depends on whether your employment was legally transferred or genuinely terminated and restarted. If you received a settlement, that period is closed. If you didn’t, argue for continuity.

Your job title, department or salary changed

None of these break continuity. A promotion is not a new job.

You took unpaid leave

Continuity holds, but the unpaid days themselves are deducted from your service period before the calculation runs.

How to Prove Your Original Start Date

If HR has used the wrong date, you need documents. These are the ones that carry weight, roughly in order:
Your first employment contract. The original one, from the year you joined. This is the strongest evidence you can produce.

Your MOHRE contract history. Every registered contract you’ve signed sits in the system. You can view these through the MOHRE app.
Your residence visa history. Original entry permit and each renewal since. Continuous sponsorship by the same employer is strong supporting evidence.

Bank statements. Salary transfers from the same employer, month after month, with no gap. Hard to argue with.
Your Emirates ID history. Issued and renewed under the same employer.
Older payslips. Especially any that show a service date or employee number that predates the current contract.
You don’t need all of these. A first contract plus continuous salary transfers usually settles it.

If Your Employer Has Used the Wrong Date

1. Ask which date they used, in writing. Request an itemised settlement statement showing the service start date, the basic salary applied, and the days calculated in each band. Most of the time this alone resolves it, because it forces someone to look at the file.

2. Reply with your evidence. Send your original contract and your calculation from the correct date. State that gratuity is based on continuous service under Federal Decree-Law No. 33 of 2021, not on the term of the current contract.

3. Don’t sign the settlement. A signed release is considerably harder to reopen. There’s no deadline that justifies signing a figure you know is wrong.

4. File a MOHRE complaint if they hold their position. Lodge it through the call centre, smart app or a service centre. MOHRE will attempt conciliation and refers unresolved cases to the labour court. Labour claims are generally exempt from court fees at the initial stages.

Free zone employees file with their free zone authority instead. DIFC and ADGM have their own tribunals.

One Thing Renewals Genuinely Do Change

To be fair to employers, renewals aren’t entirely irrelevant.

Your notice period and early termination terms come from your current contract, not your first one. If your original contract had a one-month notice and your latest has three, three applies.

Your basic salary for the calculation is your last one — the figure in your current contract. If you’ve had raises across renewals, that works in your favour, because the higher figure applies to your entire service period.

So renewals affect the terms you leave under. They just don’t affect how long you’ve been there.
